TERMS AND CONDITIONS OF SERVICE FOR ONLINE PURCHASES – TERMLY AND SHORT COURSES

1. By purchasing lessons and courses online you acknowledge that lessons and courses are to be held and redeemed at one of the available branches. No classes will be held at any other premises other than the Legacy School of Music Facilities. 

2. Lessons and courses bought online are non refundable. 

3. Online purchases may from time to time have special requirements or offers that do not apply to in store purchases. Enrolling within campus may not carry the same specials that are available online.

TERMS AND CONDITIONS OF SERVICE

  1. Agreement: This agreement between you and us consists of the Student Enrolment Form and these Terms and Conditions. Upon signature of the Student Enrolment Form, these Terms and Conditions apply. PLEASE NOTE THAT IF A COMPLETED ENROLLEMENT FORM IS NOT RETURNED TO LEGACY THESE TERMS AND CONDITIONS WILL AUTOMATICALLY APPLY ON PAYMENT OF THE INVOICE.

Attendance:

2.1  Each term has 11 (ELEVEN) classes.

2.2  If a student misses a class, it is forfeited unless the teacher has a suitable, available

opening for a catch-up class within the next 7 (SEVEN) days.

2.3  A 2 (TWO) hour notice period is required to cancel a class on the same day, Should a

class not be cancelled within the required time period or should a student not arrive

for a class without informing the school, the class is forfeited.

2.4  If we cancel a class, we will reschedule a catch-up class.

3. Payment: 

Must be made in advance. Either full payment upfront for the term or by monthly debit order.

4.Notice: 

A full calender months’ written notice is required PRIOR to terminating this agreement. The 4 notice period classes will be added to the invoice and will be for your account. Should a student not return to class in the new term and is unreachable for the first week of term, the student will be removed from the timetable. You remain liable to pay the month in full. (If no written notice is sent in the lessons will continue to be charged to you and will be for your account.)

5. Annual Increase: 

Legacy institutes an annual increase which is implemented at the start of Term 2 each year.
6. Cancellation of Agreement: 

This agreement will terminate with immediate effect upon non-payment and we reserve the right to demand payment by way of legal action if need be.

7. All teaching material and methods remain the property of Legacy School of Music.

Legacy reserves the right to prosecute anyone found using these for private gain in either a personal or business capacity.
8. Legacy reserves the right to immediately refund a student and suspend further classes should circumstances arise which makes the professional and effective teaching of a student impossible.

9.Operating Hours: 10am – 7pm Monday to Friday ; 9am – 1pm Saturdays PUBLIC HOLIDAYS – CLOSED


DEBIT ORDER / MONTHLY SUBSCRIPTIONS 

I/We hereby authorise Netcash (Pty) Ltd to issue and deliver payment instructions to your banker for collection against my/our abovementioned account at my/our abovementioned bank on condition that the sum of such payment instructions will not differ from my/our obligations as agreed to in the Contract Reference Number.

The individual payment instructions so authorised must be issued and delivered on the date when the obligation in terms of the Agreement is due and the amount of each individual payment instruction may not differ as agreed to in terms of the Agreement.
The payment instructions so authorised to be issued must carry the Contract Reference Number, included in the said payment instructions, and must be provided to identify the specific contract. The said Contract Reference Number should be added to this form in section E before the issuing of any payment instruction and communicated directly after having been completed.

I /we agree that the first payment instruction will be issued and delivered on the date I /we have chosen or stipulated.

If however, the date of the payment instruction falls on a non-processing day (weekend or public holiday) I agree that
the payment instruction may be debited against my account on the following business day; or
Subsequent payment instructions will continue to be delivered in terms of this authority until the obligations in terms of the Agreement have been paid or until this authority is cancelled by me/us by giving you notice in writing of not less than the interval (as indicated in the previous clause) and sent by prepaid registered post or delivered to your address indicated above.

B. MANDATE
I/we acknowledge that all payment instructions issued by you will be treated by my/our abovementioned bank as if the instructions had been issued by me/ us personally.

C. CANCELLATION
I/we agree that although this authority and mandate may be cancelled by me/us, such cancellation will not cancel the Agreement. I/we also understand that I/we cannot reclaim amounts, which have been withdrawn from my/our account (paid) in terms of this authority and mandate if such amounts were legally owing to you.

D. ASSIGNMENT:
I/We acknowledge that this authority may be ceded or assigned to a third party if the Agreement is also ceded or assigned to that third party. Upon agreeing to the terms and conditions presented on the Monthly Subscription form, you are hereby agreeing to all of the above mentioned and stipulated here.
